IMMIGRATION UNDER NAFTA
By Andy J. Semotiuk a U.S. and Canadian Immigration Lawyer.
What does NAFTA have to do with immigration?
NAFTA is the North American Free Trade Agreement. It creates special economic and
trade relationships for the United States, Canada and Mexico. The agreement deals with
business visitors, inter-corporate transferees, investors and professionals. Most of the
agreement addresses the TN professional category.
The non-immigrant NAFTA Professional (TN) work visa allows citizens of the United
States and Mexico, as NAFTA professionals, to work in Canada. It also allows citizens
of Mexico and Canada to work in the United States. Permanent residents are not able to
apply to work as a NAFTA professional. Professionals must meet all specified
requirements. See our article entitled Professionals Under NAFTA for a complete
list and the requirements for all the professions recognized.
